Terms of Sale and Use
Last updated: November 4, 2026
Last updated: November 4, 2026
These terms apply when you use guessgift.com or buy a gift from us. "We", "us" and "GuessGift" mean GuessGift, Fredericton, New Brunswick, Canada, New Brunswick, Canada. "You" means the person placing the order (the buyer). The "recipient" is the person the gift is for.
By placing an order you agree to these terms, our Refunds and Cancellations Policy, Delivery Policy, Privacy Policy and, if you send a gift anonymously or without an address, our Anonymous Gift Policy.
1. What we do
We create curated gifts and deliver them in Fredericton, New Brunswick. Each gift is prepared to order, with carefully selected products. That is why some of the rules below (confirmation, substitutions, cancellations) work the way they do.
These terms cover personal gift orders placed on the website. Business gifting and event kits are sold on a written quote with its own terms.
2. Who can order
You must be 19 or older (the age of majority in New Brunswick) and able to enter into a binding contract. You must give us true information about yourself and the recipient.
3. Prices and taxes
- Prices are in Canadian dollars.
- Delivery inside our Fredericton delivery area is included in the price. We do not deliver outside the areas shown at checkout.
- No sales tax is charged on our gifts.
- Extra services (for example a set delivery date) are priced separately and shown before you pay.
- If a price is obviously wrong, we will contact you before taking payment; you may accept the correct price or cancel at no cost.
4. How an order works
- You place the order. You choose the gift, enter the recipient's details, card message and delivery date, and accept these terms. This is a request to buy, not yet a contract. We e-mail you a copy of your request and a link to these terms.
- We check it. We check that every item is available and that we can deliver on the date you asked, and reply within 24 hours. Until then, your order is not accepted. If we cannot reply in that time, the request is closed and you pay nothing.
- We ask for payment. If the date is available, we send you a payment request and hold the date until the time shown in it. Exceptional-tier gifts need extra preparation, so we review each one individually before asking for payment.
- Your order is confirmed when we receive your payment. That is when the contract starts. We then prepare, check and deliver your gift.
If we cannot fulfil your order as placed, we will tell you and offer another date or gift. If you do not accept, the order is cancelled and you pay nothing (or are refunded in full if you already paid).
5. Payment
- At launch we accept payment by Interac e-Transfer only. The payment request tells you the amount, where to send it and the order number to put in the transfer message. Automatic deposit is on, so no security question is needed. Your bank will show the account holder's name, GuessGift, as the recipient.
- We mark your order as paid when the transfer arrives in our account. We do not start preparing the gift before that.
- The payment request shows the exact deadline: 48 hours from our request, or earlier if your delivery date needs it. We send you a reminder before then. If the payment has not arrived by the deadline, we release the delivery date and close the order. Nothing is owed.
- We never ask for card numbers, banking passwords or security answers by e-mail, text or phone.
- Card payment through a payment processor may be added later; these terms will be updated first.
6. Gift contents and substitutions
- Each gift page lists what the gift contains, with quantities. That list describes your gift. Where an image is marked "Illustration", it shows our packaging, not the contents. Where we show a photograph, it shows a typical gift; handmade and seasonal items can look a little different.
- If an item becomes unavailable while we prepare your gift, we may replace it with an item of the same kind and equal or higher value. If a substitution would change the character of the gift, we ask you first. Details: Refunds and Cancellations Policy §4.
- Food items are sold in their original sealed packaging. We do not open, divide or repackage food. Every food item keeps its original label with ingredients and allergens. The gift page lists the allergens shown on those labels. Items are packed together with other products, so we cannot guarantee freedom from cross-contact. You can tell us about the recipient's allergies at checkout; if an item does not suit, we will replace it or contact you.
- We do not sell or deliver alcohol.
- Each gift with food carries a card listing the products it contains and their quantities.
7. Card messages and personal content
You are responsible for what you write in a card message or ask us to include. We will not include content that is threatening, harassing, hateful, sexually explicit, defamatory, or that breaks the law or someone else's rights. We may refuse or cancel an order (with a full refund) if a message breaks this rule. See also the Anonymous Gift Policy.
8. Delivery
Gifts are delivered by GuessGift or a trusted courier, on the date you choose, within the delivery window shown at checkout. What happens when nobody is home, and when a gift counts as delivered, is in the Delivery Policy. Responsibility for the gift passes to the recipient when it is delivered.
9. Cancellations, problems and refunds
See the Refunds and Cancellations Policy. Nothing in these terms takes away rights you have under New Brunswick or Canadian consumer law.
10. Gift cards
We do not sell gift cards or gift certificates at this time. If we do later, they will follow the New Brunswick Gift Cards Act (for example, no expiry date and no fees on a card with a money value), and these terms will be updated first.
11. Using the website
- Do not misuse the website: no attempts to break in, overload it, scrape it, or order in someone else's name without permission.
- The text, photos and design of the website belong to us or are used with permission. Do not copy them for commercial use.
- Product names and brands belong to their owners. Seeing them on our site means their sealed products are part of our gifts, not that they endorse us.
12. Our responsibility
We take care in preparing and delivering every gift. If something goes wrong because of us, we put it right as set out in the Refunds and Cancellations Policy. As far as the law allows, our total responsibility for an order is limited to the amount you paid for it, and we are not responsible for losses we could not reasonably foresee. This does not limit any responsibility the law does not allow us to limit.
We are not responsible for delays caused by events outside our reasonable control (for example severe weather, road closures, or a supplier being unable to deliver). If that happens we tell you as soon as we can and offer a new date or a refund for what was not delivered.
13. Changes to these terms
We may update these terms. The version that applies to your order is the one shown when you placed it.
14. Law
These terms are governed by the laws of New Brunswick and the federal laws of Canada that apply there.
